A wrongful death lawsuit has been filed in Lufkin federal court against the Burke Center, a mental health and residential services facility, and one of its employees, Jennie Weisinger.

The lawsuit, filed by Frank Chapman, alleges that his son, Jonathan Chapman, a resident at the Burke Center, died due to the gross negligence and deliberate indifference of Ms. Weisinger.

According to the complaint, Jonathan Chapman repeatedly vomited for hours while restrained in a reclined chair, and despite his pleas for medical help and requests to be taken to a hospital, Ms. Weisinger allegedly ignored his requests and failed to provide any assistance.

As a result, Mr. Chapman tragically passed away after aspirating his own vomit.

The lawsuit seeks damages under 42 U.S.C. §1983, claiming that Jonathan Chapman’s constitutional rights were violated. Marisa Allen of Martin Walker Law Firm represents the plaintiff in this case.
