A Florida company and two individuals have admitted to selling fake N95 masks and price gouging hospitals during the early stages of the COVID-19 pandemic.
JDM Supply LLC, along with Daniel Motha and Jeffrey Motha, pleaded guilty to federal charges related to misbranding medical devices and violating the Defense Production Act.
In the spring of 2020, when N95 masks were in high demand, JDM Supply and another company conspired to sell face masks falsely labeled as NIOSH-approved N95 respirators.

One hospital purchased hundreds of thousands of these masks but ultimately returned them after discovering they were not genuine. Tests later confirmed that the masks did not meet the required filtration standards for N95 respirators.
Daniel and Jeffrey Motha also admitted to using JDM Supply to exploit the desperate need for N95 masks by selling them to hospitals at inflated prices.
JDM Supply faces a potential fine of up to $500,000 or twice the amount of profit gained from the offense. Daniel and Jeffrey Motha each face up to a year in prison and fines for their roles in the scheme. Sentencing is scheduled for March 2025.
